TOKIO'S PROFESSIONAL INDEMNITY INSURANCE
POLICY IS AVAILABLE TO PROTECT YOU AND/OR
YOUR ORGANIZATION AGAINST LOSS ON ACCOUNT
OF THE FOLLOWING:
Errors and Omissions on part of the professionals
while rendering their professional services
resulting in:-
a. Death, bodily injury, illness or disease
of or to third parties,
b. Physical damage to tangible property
of third parties
c. Financial loss suffered by third parties
The scope of this Policy includes professionals
and professional organizations such as:
1. Doctors and Medical Practitioners
2. Medical Establishments,
3. Engineers, Architects, Interior Decorators,
4. Chartered Accountants, Financial Consultants,
Management Consultants,
5. Lawyers, Advocates, Solicitors and
Counsels
GENERAL EXCLUSIONS FOR
ALL PROFESSIONAL INDEMNITY INSURANCE POLICIES
We shall not be liable to pay for:
Losses assumed by an Agreement and which
would not have attached in the absence
of such Agreement.
Deliberate, willful or intentional non-compliance
of any statutory provision.
Pure financial nature losses such as loss
of goodwill, loss of market etc.
All personal injuries such as libel, slander,
false arrest, wrongful eviction, wrongful
detention, defamation, etc. and mental
injury, anguish or shock.
Fines, penalties and punitive damages.
Losses arising out of war and nuclear
perils
Employer's liability
CLAIM
All
claims lodged by third parties should
be immediately intimated to us so that
the necessary steps can be initiated for
the defence of the claim.
No admission of liability is given without
our written consent.
Multiple claims arising from the same
cause shall be treated as one claim.
We may take over defence of any claim
at our discretion.
The
Policy is issued on a 'claims made' basis
i.e. it pays in respect of claims made
during the
Policy
period following occurrences happening
after the retroactive date i.e. date of
first commencement of cover. This is subject
to the condition that cover is continuously
being renewed without any break in period
of insurance
